Platform and marketplace terms
These terms govern use of the Tiggy marketplace for tool rentals in Germany. Tiggy arranges rental contracts but is neither the owner nor lessor of listed tools.
1. Operator and scope
Tiggy is operated by CloverTree Technologies UG (haftungsbeschränkt), Scharnhorststr. 17, 80992 München, Germany. These terms cover accounts, tool listings, intermediation, messaging, bookings, payments, deposits, reviews, Tiggynator and claim functions. At launch, the service is intended solely for adult users in Germany.
2. Roles and contracting parties
- The platform-use contract is between the user and Tiggy.
- The tool-rental contract is solely between the renter and the owner identified in the listing and before the order-and-pay step.
- Tiggy intermediates, provides payment/documentation functions and may moderate under the transparent claim rules. This does not make Tiggy a party to the rental contract or give Tiggy ownership or possession of the tool.
- Providers are labelled private or commercial/trader. Mandatory consumer rights apply to consumer–trader contracts. They generally do not apply to contracts between private individuals.
3. Minimum age and account
Users must be at least 18, legally capable and authorised to use the payment and identity information provided. Information must be accurate, current and complete. Credentials must not be shared and suspected misuse must be reported promptly.
4. Owner status and verification
Owners must truthfully state whether they act privately or as traders. Anyone renting systematically, continuously or at material scale must assess their status and must not incorrectly describe themselves as private. Tiggy may request identity, address, contact, payment, register, tax and safety evidence, plausibility-check information through Stripe or reliable sources, display legally required trader details and suspend listings pending clarification. Tiggy’s label does not replace the owner’s own legal or tax assessment.
5. Listings and provider duties
- Listings must be lawful, safe, available, accurately described and free of third-party rights.
- Price, deposit, handover, return, condition, accessories, restrictions and trader status must be fully disclosed.
- Stolen, counterfeit, recalled, unsafe, manipulated or unlawful tools are prohibited. Particularly hazardous categories may be excluded under Tiggy’s safety rules.
- Owners warrant that they are entitled to rent the tool and that it is safe to operate, properly maintained, complete and suitable for the described purpose at handover.
- Manuals, known defects, required protective equipment, age, qualification and use restrictions, and recalls must be clearly disclosed.
6. Booking and contract formation
The rental request is initially non-binding. After acceptance by the owner, the renter decides in the final booking step whether to place an order carrying an obligation to pay. The rental contract is formed only when the renter activates the button clearly labelled as carrying a payment obligation and payment is successfully confirmed. Immediately beforehand, Tiggy prominently displays the owner and status, tool, rental period, rental price, Tiggy platform fee including VAT, total price, deposit, payment method and incorporated terms. Input errors can be corrected until then. The booking confirmation is provided by email on a durable medium.
7. Prices, payment and platform fee
At launch, Tiggy earns revenue solely from the platform fee or commission disclosed during booking. There are no hidden membership or listing fees. The rental price, allocation of fees and total displayed immediately before booking apply. Stripe processes payments and payouts; Tiggy does not store full card details or accept customer funds outside the regulated Stripe payment flow. Payment is successful only after server-side Stripe verification. Payouts occur at the milestone disclosed in the booking flow, subject to refunds, claims, security checks and Stripe Connect availability.
8. Deposit and payment authorisation
- The deposit is not collected at booking. With separately displayed agreement, Stripe saves a payment method for a potential later contractual deposit charge.
- Shortly before pickup, Stripe may place an authorisation up to the displayed deposit. An authorisation is not a final charge.
- Pickup is available only when the required authorisation is active and both parties have confirmed the pickup condition report.
- If no timely claim is opened, the authorisation is released after the return/claim window. Issuer display times may vary.
- A charge is limited to a claim accepted by the renter, agreed between the parties or approved after documented, impartial review, and never exceeds the displayed deposit. Silence is not consent.
- Tiggy cannot guarantee successful card authorisation or collection. Further legal claims exist solely between the rental parties and must be pursued outside the deposit function.
9. Handover, return and condition reports
At pickup and return, renter and owner jointly check condition, function, serial number and accessories and upload clear, timely and truthful evidence. The renter may use the tool only as intended, in accordance with instructions and restrictions, with required protective equipment, and not under the influence of alcohol or drugs. Transfer to unauthorised third parties, manipulation of safety devices and unlawful use are prohibited. A report confirmed by both parties is important evidence but does not waive mandatory rights or rights concerning fraudulently concealed defects.
10. Claim procedure
- The owner must open a claim within 24 hours after the return confirmed in Tiggy and provide category, amount, reasons and evidence.
- The renter has 48 hours to accept, contest or make a reasoned counterproposal.
- No response does not automatically authorise a charge for the owner; the case moves to documented Tiggy review.
- If disputed, either party can escalate to Tiggy review. Both sides may respond; the decision and payment approval are documented and, where practicable, organisationally separated.
- Tiggy assesses only deposit processing using platform records. This is not arbitration and does not exclude courts or mandatory rights.
- Tiggy charges no claim-processing fee at MVP launch. Only proven loss caused by the rental use is considered; ordinary wear, pre-existing damage, improvements and appropriate depreciation are taken into account.
11. Cancellation, refunds and withdrawal
Before confirmed pickup, renter and owner may generally cancel through Tiggy without a fee. Any collected rental payment and platform fee are refunded to the original payment method. After pickup, voluntary ordinary cancellation is unavailable; an agreed early return can be documented. 12. Reviews, communications and notices
Reviews must reflect genuine experience and remain factual. Illegal content, harassment, discrimination, manipulation and circumvention of platform safety/payment functions are prohibited. Suspected illegal content can be reported to info@clovertreetech.com with URL/ID, reasons, contact details and a good-faith statement. Affected users generally receive reasons and available complaint options.
13. Tiggynator
AI-generated content is guidance only, can be incomplete or incorrect and does not replace professional advice, manuals or safety checks. Users must verify outputs and must not submit unnecessary sensitive or third-party personal data.
14. Tax, insurance and individual responsibility
Owners are responsible for the tax classification and declaration of rental income and for required permits and insurance. Tiggy may collect tax information and make reports where legally required. Unless expressly stated otherwise during booking, Tiggy does not provide property, liability, accident or comprehensive insurance. Users must assess their own insurance coverage.
15. Suspension and termination
Users may terminate their account where no open contracts, payments, claims or retention duties prevent deletion. Tiggy may proportionately restrict content or accounts for illegality, material breach, security risk or fraud. Where legally permitted, reasons, duration and internal complaint options are provided. Urgent risk measures may be taken without advance notice.
16. Liability
Tiggy has unlimited liability for intent and gross negligence, injury to life/body/health, product-liability obligations and guarantees. For slight negligence involving an essential contractual obligation, liability is limited to foreseeable typical loss. Other liability for slight negligence is excluded where legally permitted. The relevant provider is primarily responsible for performance, safety and legality of the intermediated offer; Tiggy’s own statutory duties remain unaffected.
17. Law, disputes and changes
German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. Mandatory protections of a consumer’s habitual residence remain unaffected. Statutory venues apply. CloverTree Technologies UG (haftungsbeschränkt) is neither willing nor obliged to participate in consumer arbitration. Material changes are communicated transparently with reasonable notice; existing bookings generally remain governed by the version incorporated at contract formation.
18. Contract language, storage and contact
Contract languages are German and, where offered in the booking flow, English. Tiggy stores the version of these terms applicable to the booking and provides it with the booking confirmation.
